Abstract :Time limits established for arrest has been an important concern of human rights law in the context of right to liberty and freedom . Long arrest periods would unfairly limit the freedom of individuals . The Code of Criminal Procedures in Turkey has a provision on time limits of arrest . However, due to the unclear wording, provisions in other laws and some problems emerging from the implementation of the Code the European Court of Human Rights, international human rights bodies, lawyers and civil human rights organizations has continued to criticize long arrest periods in Turkey . In this article, Criminal Procedural Law and recent judgments on time limits of arrest given by the Constitutional Court will be evaluated in the light of the Constitution, European Court of Human Rights judgments and comparative lawKeywords : Arrest, upper time limits for arrest, European Court of Human Rights, Right to liberty and security, comparative criminal procedural law
